1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Sensible, including the Sensible Chrome browser extension, parent dashboard, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

To use the Service, you must create an account and affirmatively accept these Terms during the registration process. By selecting the option indicating your agreement to these Terms when creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you are using the Service on behalf of a child as a parent or legal guardian, you represent and warrant that you have the legal authority to enter into these Terms and to authorize the use of the Service for monitoring the child's activity.

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect information in connection with the Service. The Privacy Policy is incorporated into these Terms by reference and forms part of this agreement. By using the Service, you acknowledge that you have reviewed and understand the Privacy Policy.

2. Description of the Service

Sensible provides a parental monitoring platform designed to help parents and legal guardians better understand and supervise their children's interactions with artificial intelligence chat services. The Service allows parents to view and review certain text-based interactions between their child and supported AI chatbot platforms and to receive alerts regarding potentially concerning content. The Service is intended to assist parents in maintaining visibility into their child's AI-related activities. Sensible is not intended to replace parental supervision or judgment.

The Service operates through two primary components:

  • Browser Extension: A Chrome browser extension installed on the child's browser profile that captures certain text-based interactions with supported AI platforms.
  • Parent Dashboard: A web-based dashboard that allows parents or legal guardians to view conversation summaries, alerts, and monitoring settings associated with a linked child profile and device.

Parents are responsible for properly installing the extension, linking the child's device to their account, and managing the monitoring settings available through the Service.

The Service is designed to monitor interactions on certain third-party artificial intelligence platforms, which may include services such as ChatGPT, Claude, Gemini, Character.AI, Perplexity, Abby AI, and other similar AI chatbot services that may be supported from time to time. Sensible is not affiliated with, endorsed by, or sponsored by any of these third-party platforms. Your child's use of those platforms remains subject to the respective terms and policies of those providers.

The Service is dependent on the technical functionality and availability of supported third-party platforms and browser environments. Sensible cannot guarantee that monitoring will function without interruption or that all interactions will be captured. Changes to third-party platforms, browser environments, or technical limitations may affect the Service's ability to capture or analyze conversations. Sensible may modify, suspend, or discontinue certain monitoring capabilities as necessary to maintain or improve the Service.

3. Eligibility and Account Requirements

3.1 Parent or Legal Guardian Requirement

The Service is intended for use only by parents or legal guardians who wish to monitor the AI chatbot interactions of their minor children. By creating an account or using the Service, you represent and warrant that you are the parent or legal guardian of any child whose activity you monitor through the Service and that you have the legal authority to authorize such monitoring. You agree that you will use the Service solely to monitor the online AI interactions of your own minor child or children and not for monitoring any other individuals.

To create an account and use the Service, you must be at least eighteen (18) years old. By registering for the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. The Service is not intended to be used directly by children. Children do not create accounts or interact with the Service interface.

3.2 Authority to Monitor the Child

By linking a child's device or browser profile to your account, you represent and warrant that you have the legal authority to monitor that child's online activity and communications. You are responsible for ensuring that your use of the Service complies with all applicable laws, including any laws related to monitoring or recording communications. You agree to use the Service only for lawful parental monitoring purposes and not for surveillance, commercial monitoring, or monitoring individuals over whom you do not have legal authority.

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You are also responsible for all activities that occur under your account, including the linking of child profiles and devices. You agree to notify Sensible promptly if you become aware of any unauthorized access to your account or any other security breach related to your use of the Service.

4. Parental Authorization and Monitoring

4.1 Authorization to Monitor AI Conversations

The Service allows parents and legal guardians to monitor certain text-based interactions between their child and supported artificial intelligence chatbot platforms. By linking a child's device or browser profile to your Sensible account, you authorize Sensible to capture, process, and present those interactions through the Service for parental oversight.

You acknowledge that the Service may capture and display text-based prompts and responses exchanged between the child and supported AI platforms. The Service does not monitor all online activity and is limited to the supported platforms and functionality available at the time of use.

You are responsible for informing your child that monitoring may occur when the Service is installed or active on their device or browser profile. Sensible encourages parents to maintain open communication with their children regarding the use of monitoring tools and their purpose. The Service may display visual indicators or other notices when monitoring functionality is active. Parents remain responsible for ensuring that monitoring is conducted transparently and appropriately.

4.2 Compliance with Applicable Monitoring Laws

You agree that you are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations relating to parental monitoring, communications interception, or electronic surveillance in your jurisdiction.

Sensible does not provide legal advice regarding the legality of monitoring communications in your location. By using the Service, you represent that you have the legal authority to monitor the child's activity and that your use of the Service complies with applicable law.

4.3 Prohibited Monitoring Scenarios

You may not use the Service to monitor individuals for whom you do not have legal parental or guardian authority. Without limiting the foregoing, you agree not to use the Service to:

  • Monitor adults or individuals over the age of eighteen (18) without their explicit consent
  • Monitor children who are not your legal dependents or under your legal guardianship
  • Conduct workplace, commercial, or investigative surveillance
  • Monitor spouses, partners, employees, or other individuals for non-parental purposes

Any misuse of the Service for unauthorized monitoring may result in suspension or termination of your account.

5. Account Registration and Device Linking

5.1 Account Creation Process

To access and use the Service, you must create a Sensible account through the registration process provided on the Sensible website or application. During registration, you will be required to provide certain information, such as your email address and a password. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate. You are responsible for ensuring that your account information remains accurate and up to date.

After creating an account, you may create one or more child profiles within the parent dashboard to associate monitored activity with a specific child. Child profiles may include limited identifying information, such as a name or nickname, monitoring preferences, and device pairing information.

You represent and warrant that you are the parent or legal guardian of any child for whom you create a profile and that you have the legal authority to monitor that child's interactions using the Service.

5.2 Device Linking and Management

To enable monitoring functionality, a parent must link a child's device or browser profile to their Sensible account. Device linking may occur by installing the Sensible browser extension and entering a unique pairing code or a similar authentication mechanism.

Once a device is linked, the Service may begin capturing supported interactions from that device in accordance with the monitoring settings selected by the parent. Parents may manage linked devices through the parent dashboard, including adding, revoking, or adjusting monitoring settings for each device.

5.3 Responsibility for Linked Devices

You are responsible for all activity that occurs through devices linked to your account. This includes ensuring that the extension is installed only on devices you are authorized to monitor and that monitoring settings are used appropriately.

If you believe a device has been linked without authorization or should no longer be monitored, you should promptly revoke the device's access through the dashboard or contact Sensible for assistance.

6. Acceptable Use of the Service

Sensible grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Service solely for its intended purpose of monitoring the AI chatbot interactions of your minor child or children. Your use of the Service must comply with these Terms and all applicable laws and regulations. You agree to use the Service only for lawful parental monitoring and oversight, and in a manner consistent with the platform's functionality and purpose.

You agree not to use the Service in any way that:

  • Violates any applicable law, regulation, or legal obligation
  • Infringes upon the rights of any third party
  • Attempts to interfere with or disrupt the operation of the Service or its infrastructure
  • Circumvents, disables, or otherwise interferes with security-related features of the Service
  • Attempts to gain unauthorized access to the Service, other user accounts, or related systems
  • Uses automated scripts, bots, or scraping tools to access the Service without authorization
  • Copies, modifies, distributes, sells, or leases any part of the Service without authorization

You agree not to misuse the Service's monitoring capabilities. In particular, you may not use the Service to:

  • Conduct surveillance of individuals for whom you do not have legal parental or guardian authority
  • Monitor adults, employees, partners, or other individuals outside the intended parental monitoring context
  • Use monitoring features for harassment, intimidation, stalking, or other harmful purposes
  • Attempt to collect information unrelated to the parental monitoring purpose of the Service

Any misuse of monitoring functionality may result in immediate suspension or termination of your account.

You agree not to attempt to probe, scan, test, or circumvent the security of the Service or any related systems. You may not introduce viruses, malicious code, or other harmful technologies that could damage or disrupt the Service.

You also agree not to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or any of its components, except to the extent such restrictions are prohibited by applicable law. Sensible reserves the right to investigate suspected violations of this section and may suspend or terminate accounts involved in activities that threaten the security or integrity of the Service.

7. Subscription, Billing, and Payments

7.1 Free and Paid Plans

Sensible may offer both free and paid subscription plans that provide access to certain features of the Service. The availability, features, and limitations of each plan may vary and may be updated from time to time. Free plans may include limited functionality, while paid plans may provide additional monitoring features, alerts, or other capabilities. Details regarding available plans and pricing will be presented at the time of purchase or subscription.

7.2 Payment Processing

If you subscribe to a paid plan, you agree to pay all applicable fees associated with your selected subscription plan. Payments for paid subscriptions may be processed through third-party payment providers, such as Stripe or similar payment processors. By providing payment information, you authorize Sensible and its payment processor to charge the applicable subscription fees to your designated payment method. Sensible does not store full payment card information and relies on third-party payment providers to process and manage payment transactions securely.

7.3 Automatic Renewals

Paid subscriptions will automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. By subscribing to a paid plan, you authorize Sensible to automatically charge your payment method for the applicable subscription fee at the beginning of each renewal period. The billing cycle (for example, monthly or annually) will be disclosed at the time of purchase.

You may cancel your subscription at any time through your account dashboard or through the subscription management interface provided by Sensible. Cancellation will take effect at the end of the current billing period unless otherwise stated. Unless otherwise required by applicable law, subscription fees are non-refundable. Sensible may, at its sole discretion, issue refunds or credits in specific circumstances.

8. Third-Party Platforms and Integrations

The Service is designed to monitor certain interactions between a child and supported third-party artificial intelligence platforms. These platforms may include services such as ChatGPT, Claude, Gemini, Character.AI, and other AI chatbot services that Sensible may support from time to time. Your child's use of these third-party platforms is subject to the terms, policies, and practices of the respective platform providers. Sensible does not control and is not responsible for the operation, availability, or content of these external platforms.

Sensible is an independent service and is not affiliated with, endorsed by, or sponsored by any third-party AI platform monitored through the Service. References to third-party platforms are provided solely to describe compatibility with the Service. All trademarks, service marks, and product names belonging to third parties remain the property of their respective owners.

The functionality of the Service depends in part on the technical structure and availability of supported third-party platforms. Changes to those platforms, including modifications to their interfaces, features, policies, or technical infrastructure, may affect the Service's ability to capture or analyze certain interactions. Sensible does not guarantee uninterrupted monitoring or compatibility with any particular third-party platform and may modify, suspend, or discontinue certain integrations or monitoring capabilities as necessary to maintain the Service.

9. Intellectual Property

The Service, including all software, technology, designs, text, graphics, interfaces, trademarks, logos, and other materials provided through the Service, is owned by Sensible or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted in these Terms, no part of the Service may be copied, modified, distributed, sold, licensed, or otherwise exploited without the prior written permission of Sensible.

Subject to your compliance with these Terms, Sensible grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, lawful parental monitoring purposes.

This license does not grant you any ownership rights in the Service or any of its underlying technology. You may not reproduce, reverse engineer, modify, create derivative works from, or otherwise attempt to extract the source code or underlying functionality of the Service, except to the extent permitted by applicable law. If you provide Sensible with any feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you agree that Sensible may use such Feedback without restriction or compensation to you.

By submitting Feedback, you grant Sensible a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into the Service or related products and services.

10. AI-Generated Analysis and Alerts

The Service may use automated technologies, including artificial intelligence or machine-learning systems, to analyze certain text-based interactions captured through the Service. These tools may evaluate conversation content to identify topics or patterns that may indicate potentially concerning behavior and may generate alerts, summaries, or other notifications for parents or legal guardians. These automated analyses are intended to assist parents in monitoring their child's interactions with supported AI platforms and are provided solely as informational tools.

AI-based analysis is inherently imperfect and may produce inaccurate or incomplete results. Alerts or classifications generated by the Service may contain false positives (incorrectly flagging benign content) or false negatives (failing to detect concerning content).

Parents should not rely solely on the Service's automated alerts or classifications to assess a child's safety or well-being. The Service is designed to support parental awareness and supervision, but it cannot replace direct parental oversight or communication with a child.

Sensible does not guarantee that the Service will detect all harmful, inappropriate, or concerning interactions. The Service cannot ensure the prevention of any specific behavior, risk, or harm. You acknowledge that the Service is provided as a supplemental tool to assist parental supervision and that you remain fully responsible for your child's safety, supervision, and well-being.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SENSIBLE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. SENSIBLE DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, OPERATE WITHOUT INTERRUPTION, BE ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

The availability and functionality of the Service may depend on third-party technologies, internet connectivity, browser environments, and supported AI platforms. Sensible does not guarantee continuous availability of the Service or that all interactions will be captured or processed. Maintenance, technical issues, changes to supported platforms, or other factors may affect the performance or availability of certain features of the Service.

The Service is intended to assist parents and legal guardians in supervising their child's interactions with AI platforms, but it does not replace active parental supervision. Sensible does not assume responsibility for monitoring a child's behavior or ensuring their safety. Parents remain solely responsible for their child's supervision, communication, and well-being, and for determining how best to use the Service as part of their parenting approach.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SENSIBLE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, DEVICE OR SYSTEM FAILURE, OR ANY HARM RESULTING FROM THE SERVICE FAILING TO DETECT OR FLAG CERTAIN CONTENT OR INTERACTIONS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF SENSIBLE FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID TO SENSIBLE FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100).

You acknowledge and agree that the limitations of liability set forth in this section are an essential basis of the agreement between you and Sensible. The Service would not be provided without such limitations, and these limitations apply even if any remedy fails of its essential purpose.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sensible and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your monitoring activities or any dispute related to your use of the Service to monitor a child's interactions
  • Your infringement or alleged infringement of any rights of a third party

Sensible reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Sensible in asserting any available defenses.

14. Suspension and Termination

You may terminate your account and stop using the Service at any time by deleting your account through the parent dashboard or by contacting Sensible support. Termination of your account will stop future access to the Service and prevent further monitoring activity associated with your account.

Sensible may suspend or terminate your access to the Service, with or without notice, if:

  • You violate these Terms
  • You misuse the Service or monitoring functionality
  • Your use of the Service creates legal or security risks
  • You fail to pay applicable subscription fees
  • Sensible determines that suspension or termination is necessary to protect the Service or its users

Sensible may also suspend or discontinue the Service, in whole or in part, at its discretion.

Upon termination of your account, your access to the Service will immediately cease, monitoring of any linked devices will stop, and your data will be handled in accordance with the Sensible Privacy Policy.

Any provisions of these Terms that by their nature should survive termination, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification, will remain in effect after termination.

15. Changes to the Service and Terms

Sensible may modify, update, suspend, or discontinue any part of the Service at any time, including features, functionality, or integrations with third-party platforms. Such changes may occur for operational, technical, legal, or business reasons. While Sensible will make reasonable efforts to provide notice of material changes when practicable, the Service may be updated without prior notice where necessary to maintain functionality, security, or compliance.

Sensible may revise or update these Terms from time to time. If material changes are made, Sensible will provide notice through the Service, by email, or through other reasonable means.

The updated Terms will become effective on the date specified in the notice. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.

16. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law principles.

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute with Sensible informally. You must contact Sensible by email at hello@getsensible.app and provide a written description of the issue. Both parties agree to attempt to resolve the dispute in good faith for at least thirty (30) days before pursuing arbitration or other legal remedies.

If a dispute cannot be resolved through informal resolution, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules. The arbitration will take place in Stamford, Connecticut, unless otherwise agreed by the parties. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

To the fullest extent permitted by law, you agree that any dispute arising out of or relating to the Service will be resolved on an individual basis and not as part of a class action, consolidated action, or representative proceeding. You waive any right to participate as a plaintiff or class member in any purported class or representative action related to the Service or these Terms.

17. General Provisions

  • 17.1 Entire Agreement: These Terms, together with the Sensible Privacy Policy and any other policies or terms expressly incorporated by reference, constitute the entire agreement between you and Sensible regarding your use of the Service. These Terms supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the subject matter of these Terms.
  • 17.2 Severability: If any provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
  • 17.3 Assignment: You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of Sensible. Any attempted assignment without such consent will be null and void. Sensible may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, corporate restructuring, or similar transaction.
  • 17.4 Waiver: The failure of Sensible to enforce any provision of these Terms shall not be deemed a waiver of that provision or of the right to enforce it in the future. Any waiver of a provision of these Terms will be effective only if in writing and signed by an authorized representative of Sensible.
